Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the Nursing the Nurse members area and related mobile and web applications (together, the “Service”).

The Service is provided by Nursing the Nurse (“we”, “us”, “our”).

By creating an account, logging in or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

We operate educational and coaching services for nurses, including online resources, events and this members area / app.

2. Who the Service is for (and who it is not for)

The Service is designed for nurses and healthcare workers seeking wellbeing, education and personal development support.

It is not designed for:

  • emergency or crisis support

  • diagnosis or treatment of medical or mental health conditions

  • workplace investigations, legal advice or industrial representation

You are responsible for deciding whether the Service is appropriate for you and for seeking independent professional advice where needed.

3. Not medical, mental health or employment advice

All content in the Service is general information and education only.

It:

  • does not take into account your personal medical, mental health or employment situation

  • is not a substitute for professional advice from your doctor, psychologist, allied health provider, lawyer, union or other adviser

  • does not establish a therapeutic, clinical, employment or legal relationship

You should not disregard or delay seeking professional help because of anything you read, watch or hear in the Service.

If you are in crisis, at risk of harm, or worried about someone’s immediate safety, contact emergency services or your local crisis line straight away.

4. Accounts and security

To access the Service you may need to create an account and set a password.

You agree that:

  • all information you provide is true, accurate and up to date

  • you are responsible for maintaining the confidentiality of your login details

  • you are responsible for all activity under your account

We may suspend or terminate your account if we reasonably believe you have breached these Terms, misused the Service, or provided false information.

You must notify us promptly if you suspect any unauthorised use of your account.

5. Acceptable use

You agree to use the Service legally and respectfully and not to:

  • harass, abuse, bully or mistreat other members, contributors or staff

  • post, upload or share content that is unlawful, defamatory, discriminatory, hateful, explicit or otherwise offensive

  • violate the intellectual property rights of Nursing the Nurse or any third party

  • hack, attempt to gain unauthorised access, or interfere with the security or proper functioning of the Service

  • use the Service for fraudulent or misleading purposes

If we believe you are using the Service illegally or in breach of these Terms, we may limit, suspend or terminate your access and take any legal steps we consider appropriate.

6. Memberships, subscriptions and payments

Access to the members area / app is provided on a subscription basis (for example, monthly or yearly), sometimes including a free or discounted trial period.

Key points:

  • Subscription details (price, billing period, inclusions and any trial period) are shown at the point of purchase.

  • If you subscribe via an app store (Apple App Store, Google Play), billing and cancellation are managed through that store, and their terms will also apply.

  • If you subscribe directly via our website, payments are processed by our chosen payment provider(s), and your subscription will renew automatically unless cancelled.

By providing payment details and starting a subscription, you authorise us and/or the relevant app store/payment provider to charge the subscription fees to your chosen payment method on a recurring basis until you cancel.

You must ensure your payment details are current and that there are sufficient funds available.

We may change subscription prices or inclusions from time to time. If we make a material change that affects your existing subscription, we will give reasonable notice where practicable.

7. Cancellations and refunds

Cancelling via app stores

If you subscribed via Apple App Store or Google Play, you must cancel through your app store account settings. We cannot cancel on your behalf.

Cancelling direct subscriptions

If you subscribed via our website, you can cancel via your account settings or by contacting us at [email protected] before your next billing date.

Unless otherwise stated at the time of purchase or required by law:

  • your cancellation will take effect at the end of your current billing period

  • subscription fees already paid are non-refundable

  • partial periods are not refunded

Nothing in these Terms limits your rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or other consumer protection laws that cannot lawfully be excluded.

8. Other goods and services

From time to time we may offer other goods and services (such as online courses, workbooks, events or coaching) through the Service or website.

Any additional terms presented at the point of purchase will apply alongside these Terms.

9. Intellectual property

Unless we say otherwise, all content in the Service, including text, videos, audio, images, logos, downloads, and other materials, is owned by or licensed to Nursing the Nurse.

You are granted a personal, non-exclusive, non-transferable licence to access and use the content for your own private, non-commercial use.

You must not:

  • copy, reproduce, distribute, share or publish content from the Service to people who have not purchased access

  • sell, resell, or commercially exploit any content

  • create derivative works based on our content, except as allowed by law or with our written permission

If you wish to use our materials in your workplace or for group education, please contact us for a separate licence.

10. User-generated content

If you post or upload any content in the Service (such as comments, messages, reviews, or shared resources):

  • you remain the owner of your content

  • you grant us a non-exclusive, royalty-free, worldwide licence to use, display, adapt and reproduce that content within the Service for the purpose of operating and improving the Service

  • you confirm that you have the right to share that content and that it does not infringe any third-party rights

We may remove user-generated content that we reasonably consider inappropriate, harmful or in breach of these Terms.

11. Availability and changes to the Service

We aim to keep the Service available and functioning, but we do not guarantee uninterrupted access or that it will always be error-free.

We may:

  • update, change, or remove features or content

  • perform maintenance that temporarily limits access

  • discontinue part or all of the Service

Where changes have a significant impact on paid members, we will give reasonable notice where practicable (for example, via email or in-app notification).

12. Limitation of liability

To the maximum extent permitted by law:

  • the Service is provided “as is” and “as available”.

  • we do not promise particular outcomes (for example, improved health, job changes, or financial results)

  • we are not responsible for any loss or damage arising from your use of or reliance on the Service, except where we cannot lawfully exclude liability

Where our liability cannot be excluded under the Australian Consumer Law or other applicable law, our liability is limited, at our option, to:

  • resupplying the relevant services, or

  • paying the cost of having the services supplied again.

We are not liable for any indirect, incidental, special or consequential loss, such as loss of income, reputation or data, except where such liability cannot be excluded by law.

13. Indemnity

Except where prohibited by law, you agree to indemnify and hold harmless Nursing the Nurse and our officers, employees, contractors, and agents from any claims, losses, damages, liabilities, costs or expenses (including legal fees) arising out of:

  • your use or misuse of the Service, or

  • your breach of these Terms.

The Service may link to, or rely on, third-party services such as app stores, payment providers, Zoom, analytics tools, or other platforms.

We do not control and are not responsible for the content, policies, or practices of those third parties. Your use of their services may be subject to separate terms and privacy policies.

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms. By using the Service, you agree to our collection, use and disclosure of personal information as described in that policy.

16. Changes to these Terms

We may update these Terms from time to time to remain compliant with the law and reflect changes in how we operate the Service. Updated versions will be posted within the Service or on our website, and the “Last updated” date will be changed.

Your continued use of the Service after changes take effect means you accept the updated Terms.

17. Governing law

These Terms are governed by the laws of the State of Western Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia, except where otherwise required by law.
